Short-term Rental Regulations By Area

This is for informational purposes only.  Readers should check the website for the appropriate area of the property to be rented for up-to-date and most current information.

 

Common Terms and/or Regulations:

  • Short-term rental = Rental for a term less than 30 consecutive days.
  • Booking = an agreement to rent a unit for a period of less than 30 consecutive days
  • All STRs must have a Colorado Sales Tax license and report & pay taxes quarterly.  Taxes include CO State Tax, County Tax, Town Tax (if applicable), metro district tax.  Usually around 10-15.5% (each is different - look it up!)
  • HOA Regulations trump Town/County regulations!
  • Responsible Agent = A responsible agent must be available 24/7 and respond to a complaint within 1 hour.  A rental agent is a management company or other person employed or engaged by the licensee to advertise the accommodation unit for rent, or to remit any required tax to the Town. A rental agent can act as responsible agent if designated by the licensee
  • Unincorporated Summit County only applied to areas NOT within Town limits.  

 

Unincorporated Summit County:

  • Resort Zone (this is really just Copper Mountain now)
    • SFH/Duplex/TH:
      • 2 per bedroom plus 4 OR 1 person per 200 sq feet of living area (whichever allows for greater occupancy.
    • Condos:
      • 2 per bedroom plus 4 OR 2 per bedroom plus 2 in buildings with interior egress components less than 44” wide & without a sprinkler system OR 1 person per 200 square feet of living area, whichever allows for greater occupancy.  If legal lock-off - can have 4 in the legal lockoff.
    • No Annual Limit on Bookings
    • No Limit on the number of STR Licenses that can be issued
    • STR License Fee - $295/year
    • Maximum Occupancy:
  • Neighborhood Overlay Zone:
    • Requirement:  STR Property must be the primary residence of a member of the local workforce and must have been primary residence for at least 9 months.
    • Maximum Occupancy:  2 renters per bedroom + 2.
    • STR License Fee = $240/year
    • Type I
    • Type II
      • Maximum Occupancy:  2 per bedroom + 2.
      • No more than 35 bookings per year (October 1 - September 30th) unless approved as a Bed & Breakfast.
      • STR License Fee = $360/year
      • Where things stand now:
        • Lower Blue Basin cap:  550 (508 Type II licenses as of 1/2026)
        • Upper Blue Basin cap:  590 (563 Type II licenses as of 1/2026)
        • Snake River Basin cap: 130 (137 Type II licenses as of 1/2026)
        • Ten Mile Basin cap:  20 (24 Type II licenses as if 1/2026)

Town of Breckenridge:

  • Zones
    • Resort Zone: 100% of all housing units can have a STR License
    • Zone 1 (Tourism Zone):  92% of all housing units can have a STR License
    • Zone 2 (Downtown Core):  51% of all housing units can have a STR License
    • Zone 3 (Residential Areas):  10% of all housing units can have a STR License
  • Waitlist & Current Licenses:
    • Resort:  97 Licenses available
    • Zone 1:  455 Licenses available
    • Zone 2:   0 Available
    • Zone 3:  -688 Available
  • Occupancy Rules:
    • 2 per bedroom + 4
    • Studios are allowed 4
  • License Cost 
    • Studio - $75
    • 1-bedroom - $100
    • 2-bedroom - $125
    • 3-bedroom - $150
    • 4 or more bedrooms - $175
    • The regulatory fee will not be imposed when an accommodation unit is the license holder's primary residence and is rented out for a period of time not to exceed 21 days out of the year.

Town of Blue River:

  • Currently, no limit on the number of STR Licenses
  • In order to renew the license, you must have 10+ rental days per year.
  • Occupancy = 2 guests per bedroom plus 2.
  • Cost of License:  $300/year
  • Responsible Agent must respond within 30 minutes of complaint

 

Town of Dillon:

 

Town of Keystone:

  • Currently, no limit on the number of STR Licenses
  • Maximum Occupancy:
    • SFH/Duplex/TH:
      • 2 per bedroom plus 4 OR 1 person per 200 sq feet of living area (whichever allows for greater occupancy.
    • Condos:

    • Zone 3 - Deed Restricted = 0%
  • Waitlist
    • Zone 1 - 23 licenses available
    • Zone 2 - 301 Licenses available
  • Occupancy = 2 per bedroom plus 2
  • Cost of License:
    • Studio –$150
    • One Bedroom - $200
    • Two Bedrooms –$250
    • Three Bedrooms –$300
    • Four Bedrooms –$350
    • Five bedrooms – $450
